New Zealand’s latest campaign to attract more Australian tourists has received mixed responses, with one legal expert cautioning travellers about the risks of visiting the country.

Peter Carter, Director of Carter Capner Law, has warned Australian travellers to “go at your own risk”, highlighting a major legal limitation: Australians cannot access compensation for injury or death caused by another party while in New Zealand.

“Speaking on behalf of all Australians, if they’re maimed in New Zealand or orphaned and their breadwinner parent dies, they can’t get anything to replace the income that is lost because of that tragedy,” Mr. Carter said.

New Zealand operates under the Accident Compensation Corporation (ACC) system, which covers medical treatment and rehabilitation for injuries but does not allow victims to sue for damages, including loss of income due to negligence.

Mr. Carter’s warning comes as New Zealand ramps up efforts to attract more Australian visitors, emphasizing outdoor adventures, extreme sports, and road trips—activities that inherently come with risks.

Legal experts advise that Australians visiting New Zealand should be aware of these legal limitations and consider additional personal insurance coverage before traveling.
