A leading accident lawyer has called for the Sea World helicopter tragedy to be the catalyst for major law reform. Peter Carter of Carter Capner Law wants the Civil Aviation Act amended to specify that operators must not only insure against bodily injury but also against harm to mental health. He says, as it stands right now, witnesses and the good Samaritans on January 2 may never be compensated for their suffering and potential loss of income. Mr. Carter has also revealed the operator and its insurer can escape all liability by arguing that joy flights are dangerous.

The government could amend this dreadful situation very quickly by clarifying a provision in the Civil Liability Act to say that light aircraft travel is not regarded as a dangerous recreational activity.
