Pacific Aria Class Action

A class action lawsuit has been filed regarding a 2017 cruise that allegedly left Brisbane and sailed into the path of a category 5 cyclone.

On May 5, that year, the P&O Pacific Aria departed Brisbane.

“Before departure, a cyclone warning had been issued for Vanuatu, as well as a forecast that the category 3 cyclone was headed in the direction of Noumea,” Carter Capner Law director Peter Carter said.

He claimed that passengers on the seven-day South Pacific cruise to Noumea and Vanuatu were not provided the option to cancel prior to boarding.

Carter reported that the cyclone reached category 4 on May 6 and category 5 on May 8.

“Upon arrival in Noumea (New Caledonia), the ship was forced to dock in the industrial port instead of the cruise ship terminal due to strong winds,” Carter explained.

“Nothing was open in the city because Noumea was on lockdown awaiting the arrival of the cyclone, and several passengers left the ship in Noumea due to the terrible sea conditions they had experienced and flew to Brisbane.”
