Brown was a provisional rider and should not have had a passenger, while the driver of the Toyota was suspended.

The crash occurred while the pair were riding in a convoy en route to Mrs Macquarie’s Chair in inner Sydney. McFadden criticized the lack of support from the convoy, stating that only “two or three” members stopped to help following the crash.
