CTP + Product Liability

If you've been injured in a caravan, camper-trailer, boat-trailer, horse-float or box-trailer incident in Queensland, multiple compensation pathways may apply. The towing vehicle's CTP insurance generally extends to its attached trailer under the Motor Accident Insurance Act, but trailer-specific causes (sway, jackknife, coupling failure, tyre defects, brake-controller faults, weight-distribution hitch failures) often also engage product liability against the manufacturer or installer, and public liability against caravan parks or campsites.

9-Month NOAC

Our caravan and trailer accident lawyers act for tow-vehicle drivers, caravan and camper-trailer occupants, motorists struck by a swaying or detached trailer, motorcyclists and cyclists clipped by an unsecured load, grey nomads injured on long-distance tours, and dependants of those killed in trailer-related incidents across Queensland.

  • Tow Vehicle Drivers & Occupants

Drivers and passengers in 4WDs, utes and SUVs towing caravans, camper-trailers, boat-trailers or horse-floats, injured by sway, jackknife, hitch failure or tyre blow-out incidents.

  • Caravan & Camper-Trailer Occupants

Family members and grey nomads injured when a caravan or camper-trailer rolls, snakes or detaches, including occupants travelling unlawfully inside while towed (CTP and contributory-negligence pathway).

  • Other Road Users

Drivers, motorcyclists, cyclists and pedestrians struck by a swaying, detached or rolled trailer, or by cargo dislodged from a poorly-restrained load.

  • Caravan Park Visitors

Holiday-makers and tourists injured at caravan parks, slip-and-trip, awning collapses, faulty park-supplied utilities, on-site vehicle strikes and unsafe site jacks (public-liability claims).

For Most Matters*

To pursue a caravan or trailer accident claim in Queensland, several pathways may apply: CTP for tow-vehicle and trailer-related road incidents, product liability under the Australian Consumer Law for defective trailers, brake controllers, hitches or tyres, public liability for caravan-park hazards, and WorkCover where the trailer was being towed in the course of work.

Core Requirements for Caravan & Trailer Accident Claims

  • Negligence or Fault. Another party must be at fault, a tow-vehicle driver, the trailer manufacturer, an installer of an aftermarket hitch or brake controller, a caravan park operator, a service-centre mechanic, or another road user. Partial fault doesn't bar a claim, it can reduce it on contributory-negligence principles (e.g., overloaded trailer, inadequate weight-distribution).
  • Documented Injury. You must have sustained a compensable personal injury requiring medical treatment, including rollover crush injuries, fractures, whiplash from sway-induced swerving, head trauma, spinal injury common to jackknife events, and psychological injury such as PTSD after a high-speed trailer detachment.
  • Insurer Identified. The at-fault tow vehicle must be identifiable and insured under Queensland's CTP scheme, its coverage extends to the attached trailer. Where the trailer was being towed by an unidentified (hit-and-run) vehicle, claims proceed against the Nominal Defendant under the strict 3-month notice rule; if the tow vehicle is identified but unregistered or uninsured, the standard 9-month NOAC deadline applies (or 1 month after you first consult a lawyer, whichever is earlier). Pure product-defect claims against a manufacturer follow a separate Australian Consumer Law pathway.
  • Time Limits Met. Strict deadlines apply: 9 months for the CTP NOAC (or 1 month from consulting a lawyer if sooner), 3 months for the Nominal Defendant scheme where the tow vehicle is unidentified, 1 month for PIPA notice to a caravan park or product manufacturer after consulting a lawyer, 6 months for WorkCover where the trailer was being towed in the course of work, and 3 years for final court proceedings.

Quick eligibility check

  • Another party was at fault
  • You have a documented injury
  • Accident occurred in QLD
  • Within time limits
  • Seeking medical treatment

Special Circumstances: Unidentified, Unregistered or Uninsured Vehicles

If the at-fault vehicle fled the scene or cannot be identified (hit-and-run), special procedures apply. Claims against the Nominal Defendant for an unidentified vehicle have a strict deadline as short as 3 months from the accident date. Where the tow vehicle is identified but unregistered or uninsured, the standard 9-month NOAC deadline applies (or 1 month after you first consult a lawyer, whichever is earlier). Early legal advice is critical in these situations. We can guide you through the Nominal Defendant procedure.

Crash types

Common Caravan & Trailer Accident Scenarios

Caravan and trailer accidents arise from a distinct set of mechanical and dynamic causes, sway, jackknife, coupling failure, brake-controller faults and tyre blow-outs being the most common. Each scenario requires tailored evidence preservation and defendant identification.

  • Trailer Sway & Snake

Aerodynamic 'snaking' caused by weight imbalance, crosswinds, overtaking trucks or excessive speed, leading to swerving, rollover or loss of tow-vehicle control. Often discloses inadequate weight-distribution hitch use, overloaded tongue weight or worn shock absorbers.

  • Jackknife Incidents

The trailer pivots out of line during braking, descent or evasive manoeuvre, causing a multi-vehicle pile-up. Common on Bruce Highway descents, wet roads and emergency-stop situations. Brake-controller calibration, electric-brake function and trailer brake-shoe wear are central evidence.

  • Coupling & Hitch Failure

Trailer detaches from the towing vehicle while in motion, usually from a worn or under-rated hitch, mis-installed weight-distribution bars, missing safety chains or fatigued kingpin. Engages product liability against the manufacturer or installer alongside CTP.

  • Tyre Blow-out & Wheel Detachment

Trailer-tyre blow-outs from under-inflation, sun-perished sidewalls, overload, or fitment of inappropriately-rated tyres. Wheel-bearing failures and complete wheel detachments are common on long outback and inland tours. Service records and tyre date-codes become decisive.

  • Brake Controller Faults

Failure of the in-cab electric brake controller or the trailer's electric brakes themselves, leading to extended stopping distances, jackknifing or rear-end collisions. Aftermarket installation faults often reveal a public-liability claim against the fitting business.

  • Wet-Weather & Hydroplaning Rollovers

Loss of control on flooded sections of the Bruce Highway, Pacific Motorway, Warrego Highway or rural roads, often caused by inadequate tyre tread, mis-distributed load or excessive towing speed in wet conditions.

  • Caravan Park Site Incidents

Slip-and-trip on uneven sites, faulty park-supplied power and water connections, awning collapses, jacks failing, and on-site vehicle strikes. Engages public-liability claims against the park operator under the Civil Liability Act 2003 (Qld).

  • Load-Loss & Cargo Strike

Items dislodging from a trailer, boats, jet-skis, motorcycles, building materials or recreational gear, striking following vehicles. Inadequate load-restraint, defective tie-down points and substandard ratchet straps are common causes.

Call 1300 529 529 as soon as you can. Notice of your claim is due within 9 months of the crash, or within 1 month of first meeting a lawyer about it, whichever comes first.

Time is critical. Strict time limits apply to road accident claims, and some steps must be taken within a few months of the accident. Contact us early so we can check the time limits that apply to you.

Who pays

Who you claim against

Road claims rarely have one answer. The at-fault driver’s CTP insurer is the usual starting point, but a hit-and-run goes to the Nominal Defendant, a road defect to the road authority (the council, or the Department of Transport and Main Roads for state-controlled roads), and a faulty vehicle or towbar to the manufacturer. We look at every avenue before we lodge anything.

  • The other vehicle was registered Its CTP insurer Allianz, QBE or Suncorp. Notice within 9 months, or 1 month after you first see a lawyer.
  • The driver drove off The Nominal Defendant Queensland’s default insurer for unidentified vehicles. Notice within 3 months, barred after 9.
  • It was unregistered or uninsured The Nominal Defendant The claim runs much like a CTP claim, against the Nominal Defendant instead.
  • Your injuries are catastrophic NIISQ as well Lifetime treatment, care and support through the National Injury Insurance Scheme, Queensland.
Compensation

What You Can Claim for Caravan & Trailer Accident Injuries

Queensland law allows compensation for the full range of losses resulting from your caravan or trailer accident. Multiple statutory pathways often run simultaneously, CTP for personal injury, product liability for the defective component, public liability for the caravan park, and WorkCover for work-towed incidents.

  • General Damages

Compensation for pain, suffering and loss of enjoyment of life. Queensland uses statutory ISV scales under the Civil Liability Regulation to value these amounts based on injury severity and permanent impairment. This includes physical pain, psychological harm, loss of amenity and reduced quality of life common in trailer-rollover and jackknife matters.

  • Medical & Treatment Costs

All reasonable and necessary medical expenses, including hospital stays, expert consultations, ongoing treatment, rehabilitation, physiotherapy, medications, medical aids, and future treatment requirements. This covers past expenses already incurred and projected future costs based on medical expert opinions. We ensure Medicare, private health fund, and hospital reimbursements are properly accounted for.

  • Past Income Loss

Compensation for wages and income lost from the date of the accident up to settlement, including self-employment losses, lost overtime, bonuses, and missed opportunities. We work with employment and taxation experts to calculate your actual financial losses. This includes situations where you've used sick leave or annual leave, you're still entitled to compensation for that lost time.

  • Future Economic Loss

Compensation for reduced earning capacity and future income loss due to permanent injuries affecting your ability to work, career progression, and employment opportunities. Vocational experts assess your work capacity and calculate lifetime earnings impacts. Even if you continue working full-time, you may be entitled to future loss if your injuries put you at risk in the labour market compared to able-bodied applicants.

  • Care & Assistance

Compensation for help you've received or will need, whether paid professional care or unpaid assistance from family and friends (gratuitous care). This is often significant in serious injury cases. We carefully document care hours and tasks so they are included in your claim. Domestic assistance you receive is compensable even if you don't pay for it, detailed records are essential.

  • Out-of-Pocket Expenses

Reimbursement for accident-related expenses including travel to medical appointments (mileage, parking, public transport), injury-related home or vehicle modifications, replacement services, and Medicare/health fund reimbursements. Every expense matters, we help you track and claim them all. Keep all receipts and maintain detailed records from day one.

No Win, No Fee*

  • Medical Treatment. Hospital, consultants, rehabilitation, medications, and future care costs
  • Lost Income. Past and future loss of earnings and reduced earning capacity
  • Pain & Suffering. General damages for physical pain, emotional distress, and loss of life's amenities
  • Care & Assistance. Paid professional care and unpaid family assistance (gratuitous care)

How CTP works

  • CTP covers you, not your car. Personal injury only: treatment, lost income, pain and suffering, and care.
  • Your car is a separate claim. Repairs go through the at-fault driver’s property insurer, or your own.
  • Both can run at once. You can run the injury claim and the property claim at the same time.

Queensland’s CTP insurers are Allianz, QBE and Suncorp. The Motor Accident Insurance Commission (MAIC) regulates CTP insurance in Queensland.

Your Claim Value

Every caravan and trailer accident claim is unique. The value depends on your specific circumstances, injuries, and their impact on your life and work.

Contact our caravan and trailer accident lawyers for a personalised assessment of your compensation entitlement.

How much compensation you may receive depends on your injuries, how they affect your work and daily life, and the law that applies at the time. General damages for pain and suffering are only one part of a claim. We can give you a clearer idea once we understand your circumstances. The bulk of most settlements comes from past and future income loss, care, treatment costs and out-of-pocket expenses, which is why thorough claim preparation matters.

Time limits

Strict Time Limits for Caravan & Trailer Accident Claims

Missing these deadlines can permanently bar your claim. Early contact with our caravan and trailer accident lawyers ensures all time limits are met and your rights are protected. Report the accident to QPS and TMR if there was injury or substantial property damage. Call 1300 529 529 for urgent assistance.

  1. 1 mth

Submit Notice of Accident Claim (NOAC)

Within 1 month after first consulting a lawyer (whichever occurs earlier, but not later than the 9-month rule unless reasonable excuse applies). This document initiates your CTP claim against the towing vehicle's insurer for trailer-related personal injury.

  2. 3 mths

    Nominal Defendant Claims (Unidentified Vehicle)

Where the towing vehicle is unidentified (hit-and-run), the NOAC must be served on the Nominal Defendant within 3 months of the accident date. An identified but unregistered or uninsured tow vehicle instead follows the standard 9-month NOAC deadline (or 1 month after you first consult a lawyer, whichever is earlier). This is one of the strictest deadlines in Queensland personal-injury law, the period runs even if you are still hospitalised.

  3. 9 mths

    Standard NOAC Deadline

For identified, registered tow vehicles, the NOAC must be lodged within 9 months of the accident date or first symptom of injury, whichever is later. Extensions possible with reasonable excuse, but you should treat 9 months as the operating deadline.

  4. 3 yrs

    Absolute Limitation Period

Court proceedings must be commenced within 3 years of the accident date under the Limitation of Actions Act. This is an absolute cut-off for most claims; different rules apply for minors and persons under disability. Most caravan and trailer claims settle through PIPA pre-court conferences.

Don't Delay Your Right to Claim

Time limits in Queensland are strict and unforgiving. Contact our caravan and trailer accident lawyers immediately to ensure your claim is lodged on time. Remember: Report the accident to Police as soon as possible and seek medical attention immediately.

Our process

Our Claim Process

Carter Capner Law's structured approach ensures your caravan or trailer accident claim is handled methodically, with senior lawyers personally managing CTP coordination, manufacturer/installer evidence preservation, and parallel product-liability and public-liability claim threads where applicable.

  1. EXIT 1

    Initial Review & Assessment

We meet with you to understand the accident circumstances, what towed what, how the incident occurred, mechanical failure indicators (sway, brake-controller behaviour, hitch condition), your injuries, employment status and medical history. We’ll explain your rights and assess every available claim pathway.

  2. EXIT 2

    Prepare & Serve NOAC

We prepare and submit your Notice of Accident Claim (NOAC) to the towing vehicle’s CTP insurer, plus PIPA Part 1 Notices on the trailer manufacturer, hitch installer, brake-controller supplier and any caravan park operator where applicable, within the required time limits.

  3. EXIT 3

    Evidence Collection & Investigation

While you focus on recovery, we investigate thoroughly. We collect police QP9 reports, witness statements, medical records, weighbridge tickets where available, hitch and brake-controller serial numbers, ACCC product-recall notices, manufacturer specifications and any caravan-park CCTV.

  4. EXIT 4

    Medical Assessment & Stabilisation

Once your injuries have stabilised (typically 9-12 months post-accident), we arrange examinations with appropriate medical experts. These independent experts assess your injuries, prognosis, and long-term impacts. Their reports form the foundation of your compensation claim, establishing both current and future needs. The insurer will also arrange independent medical examinations.

  5. EXIT 5

    Claim Formulation & Demand

Using all collected evidence and medical reports, we carefully formulate each component of your damages claim: general damages for pain and suffering, past and future income loss, medical expenses, care requirements, and all other compensable losses. We present a comprehensive demand to the insurer backed by authoritative evidence and detailed calculations.

  6. EXIT 6

    Settlement Negotiation

We arrange an informal settlement conference with the insurer to negotiate a fair resolution. These conferences are highly effective when backed by thorough preparation. Most claims settle at this stage without trial. If the insurer is reasonable, we’ll work to resolve your claim without court proceedings.

  7. EXIT 7

    Court Proceedings (If Necessary)

If the claim does not settle, we file a Claim and Statement of Claim within 60 days after the conference, unless a further period is agreed or allowed. We continue to negotiate while preparing your case for trial. If necessary, we’ll present your case before a judge, calling witnesses and expert testimony to secure the compensation to which you’re entitled by law.

Your Caravan & Trailer Claim, Properly Pursued

From CTP applications for the towing vehicle to product liability investigations into hitches, brake controllers and ATM-rated components, we run every angle. We keep you informed at each step and claim for your injuries, lost income and rehabilitation.
