Who Can Claim E-Scooter, E-Bike & PMD Accident Compensation?
Whether you ride a private e-scooter, hire a Beam or Neuron, commute on an e-bike or use a personal mobility device (PMD), Queensland law gives you rights when someone else causes your injury. We act for riders across QLD, adults, e-bike riders, rental users and the families of fatally injured riders.
Why E-Scooter & PMD Claims Are Different
Most e-scooters and PMDs are not motor vehicles for CTP purposes, so the legal pathway depends on what caused your crash. CTP applies when a registered motor vehicle is involved. Otherwise, defective rental device, road defect, single-rider crash, footpath hazard, public liability, product liability or operator-negligence frameworks apply.
-
Private & rental e-scooter riders
Riders of personal e-scooters and rental devices (Beam and Neuron) hit by motor vehicles, dooring, road defects or device faults.
-
E-bike riders
Pedal-assist e-bike riders (≤25 km/h cut-off, ≤250 W) are treated as bicycles in QLD with the same CTP rights. Throttle-only and high-powered e-bikes may be classified as motor vehicles requiring registration.
-
PMD users (skateboards, hoverboards, unicycles)
Riders of motorised skateboards, hoverboards, electric unicycles and similar PMDs injured by drivers, defective devices or path/road hazards.
-
Families of fatally injured riders
Dependency, funeral expense and Loss of Consortium claims for spouses and children where an e-scooter, e-bike or PMD rider has died.
Am I Eligible to Claim?
If you can answer yes to these five questions, you are likely entitled to compensation under Queensland’s CTP scheme or via a public liability claim. Even if you're unsure, call us. There's no obligation after the first conversation.
Core Requirements for E-Scooter, E-Bike & PMD Claims
- Negligence or Fault. Another party (driver, council, rental scheme operator, device manufacturer, race/event organiser, landowner or pedestrian) must be at least partly at fault. Partial fault doesn't bar your claim, it can reduce it on a contributory-negligence basis (e.g., not wearing a helmet, exceeding the 12 km/h footpath or 25 km/h bike-path limit, riding while affected by alcohol).
- Documented Injury. You must have sustained a compensable injury, physical or psychological, supported by medical evidence (hospital records, GP notes, imaging, treating-specialist reports).
- Identifiable Vehicle or Defendant. For CTP claims (when a registered motor vehicle is involved), the vehicle must be identifiable; otherwise the Nominal Defendant scheme applies on a strict 3-month notice. For public liability or product-liability claims, the council, landowner, rental operator or device manufacturer must be identifiable.
- Time Limits Met. A Notice of Accident Claim must be served within 9 months (CTP) or 1 month if claiming against a council under PIPA. Court proceedings within 3 years of the accident.
Quick eligibility check
- Your crash happened in Queensland
- A motor vehicle, council, landowner or other party was at least partly at fault
- The at-fault vehicle/party is identified, identifiable, or covered by Nominal Defendant
- You suffered a compensable injury (physical and/or psychological)
- You can lodge a Notice of Accident Claim within 9 months (council/PIPA claims: 9 months, or 1 month after consulting a lawyer)
Special Circumstances: Unidentified Vehicles & Council Claims
If the at-fault driver fled the scene or wasn’t identifiable, the Nominal Defendant scheme applies on a 3-month notice. If the cause was a pothole or road defect, a separate 9-month PIPA notice on the responsible council is required. Don’t miss it, talk to us early.
Common E-Scooter, E-Bike & PMD Accident Scenarios
Our e-scooter accident lawyers handle the full range of PMD claims in Queensland, from rental scheme injuries on Brisbane CBD streets to private e-bike crashes on shared paths. Each scenario requires a tailored approach to identify the right defendant and the right legal pathway.
-
Defective rental device
Brake failure, throttle stuck-on, steering or wheel collapse, battery fire on a Beam or Neuron device. Claim runs against the rental operator, preserve the device serial number and photos before returning.
-
Hit by car turning across your path
A motor vehicle turning right or left across your path fails to see you. Common at intersections, driveways and roundabouts. CTP claim against the driver's insurer, drivers must look out for vulnerable road users including PMD riders.
-
Dooring
A driver or passenger opens a vehicle door into your path while you are riding a bike lane or kerb-side. QLD Road Rule 269 requires drivers and passengers to check first. CTP liability is usually clear.
-
Close pass / sideswipe
Drivers passing too close on shared roads or sideswiping you in a bike lane. QLD's minimum passing distance (1m ≤60 km/h, 1.5m >60 km/h) applies to vehicles overtaking PMD riders too.
-
Pothole, path defect or unmarked hazard
Cracks, raised slabs, sudden drop-offs or roadworks debris on bike lanes, shared paths or footpaths. Public liability claim against the council or contractor on a strict 9-month PIPA notice.
-
Hit-and-run / unidentified vehicle
The driver flees or the vehicle is unidentified. The Nominal Defendant scheme covers you, but on a strict 3-month notice deadline. (If the vehicle is identified but unregistered, the standard 9-month Notice of Accident Claim applies instead.) Report to police immediately.
-
Single-rider rental crash (no other party)
Crashes caused by device fault, app/route failure, locked-wheel events, or hazards left by the operator. The rental operator's public liability and Australian Consumer Law guarantees may respond, even where no third party was involved.
-
Shared-path collision (PMD vs pedestrian or cyclist)
PMD-vs-pedestrian or PMD-vs-cyclist on shared paths and footpaths. General negligence claim, the at-fault party's home-and-contents personal liability cover may respond.
What to Do Right Now
MOVE QUICKLY
-
1
Get medical help
Even if you feel okay, head, neck, wrist and abdominal injuries can be silent. Document everything on hospital and GP records.
-
2
Get the at-fault party's details
Driver: name, licence, registration, insurer. Rental scheme: ride ID, device serial, app screenshots, hire start/end times. Witnesses: names and phone numbers.
-
3
Preserve the device & evidence
Photograph the scene, your device, the road or path surface and your injuries. Do NOT return a faulty rental scooter without photographs and serial number, it is critical evidence. Save GPS data, helmet-cam footage and rideshare app records.
-

Call us before the insurer or operator
CTP insurers and rental scheme operators work for themselves, not you. We'll explain your rights, identify the correct defendant and lodge the right notice on time.
In an emergency, call 000 first. Then call us on 1300 529 529, and there's no obligation after the first conversation.
Who you claim against
Road claims rarely have one answer. The at-fault driver’s CTP insurer is the usual starting point, but a hit-and-run goes to the Nominal Defendant, a road defect to the road authority (the council, or the Department of Transport and Main Roads for state-controlled roads), and a faulty vehicle or towbar to the manufacturer. We look at every avenue before we lodge anything.
- The other vehicle was registered Its CTP insurer Allianz, QBE or Suncorp. Notice within 9 months, or 1 month after you first see a lawyer.
- The driver drove off The Nominal Defendant Queensland’s default insurer for unidentified vehicles. Notice within 3 months, barred after 9.
- It was unregistered or uninsured The Nominal Defendant The claim runs much like a CTP claim, against the Nominal Defendant instead.
- Your injuries are catastrophic NIISQ as well Lifetime treatment, care and support through the National Injury Insurance Scheme, Queensland.
What You Can Claim for E-Scooter, E-Bike & PMD Injuries
Compensation in a Queensland e-scooter or PMD claim is broad. Beyond medical bills and income loss, you can recover for general damages, future treatment, care, and damage to your device and equipment, whether the claim runs through CTP, public liability or product liability.
General damages (pain & suffering)
Compensation for the physical pain and psychological impact of your injuries, assessed against Queensland’s Injury Scale Value (ISV) framework.
Past & future income loss
Wages and salary lost during recovery, plus future earning capacity and superannuation, critical for riders forced out of physically demanding or commute-dependent work.
Medical, rehab & future treatment
All reasonable and necessary treatment, including future surgeries, physiotherapy, psychology, and rehabilitation costs over your lifetime.
Care & assistance
Paid and gratuitous care, family members helping with cooking, cleaning, transport and personal care can all be compensable.
Device & equipment damage
A separate property-damage claim covers your e-scooter or e-bike, helmet, phone mount, lights and accessories. For private devices the at-fault driver's comprehensive insurance responds; for damaged rental devices the operator should not bill you for a fault that wasn't yours.
Loss of consortium / dependency
Where a rider has been killed or catastrophically injured, spouses and dependants may claim for loss of services, dependency and bereavement.
How Queensland Compensation Protects E-Scooter & PMD Riders
- Medical & rehabilitation. Hospital, surgery, physiotherapy, occupational therapy and ongoing rehabilitation, funded as reasonable and necessary.
- Past & future income loss. Wages and salary lost during recovery plus future earning capacity and superannuation.
- Pain & suffering (general damages). Compensation assessed against Queensland’s Injury Scale Value (ISV) framework.
- Care & assistance. Paid and gratuitous care from family, cooking, cleaning, transport, personal care.
How CTP works
- CTP covers you, not your car. Personal injury only: treatment, lost income, pain and suffering, and care.
- Your car is a separate claim. Repairs go through the at-fault driver’s property insurer, or your own.
- Both can run at once. You can run the injury claim and the property claim at the same time.
Queensland’s CTP insurers are Allianz, QBE and Suncorp. The Motor Accident Insurance Commission (MAIC) regulates CTP insurance in Queensland.
Your Claim Value
Every claim is different. Catastrophic injuries (spinal, brain, fatality) attract the largest awards, while soft-tissue and minor fracture cases settle for less. The strength of your evidence, medical records, witness statements, rental app data, helmet-cam footage and device photos, has a direct impact on quantum.
Common E-Scooter, E-Bike & PMD Accident Injuries
E-scooter, e-bike and PMD riders are highly vulnerable, small wheels, low ride height and limited protection mean even low-speed crashes can produce serious injuries. We help you recover the full cost of treatment, rehabilitation and lost earnings.

Why Medical Documentation Matters
Detailed medical records are the backbone of any e-scooter or PMD accident claim. Insurers and rental scheme operators don’t pay for what isn’t documented, so we work with you to make sure every injury, every appointment and every limitation is captured properly.
- Emergency & Hospital RecordsInitial medical records establish injury severity and immediate impact.
- GP & Specialist ReportsOngoing treatment notes, referrals and specialist findings build the medical timeline.
- Imaging & DiagnosticsX-rays, MRI, CT scans, the objective evidence of fractures, soft-tissue and brain injury.
- Rehabilitation & Allied HealthPhysio, occupational therapy, psychology, documenting the road back to recovery.
Strict Time Limits for E-Scooter, E-Bike & PMD Accident Claims
Missing these deadlines can permanently bar your claim. Early contact with our e-scooter and PMD accident lawyers ensures all time limits are met and your rights are protected, including notifying the rental operator promptly. Report the accident to Queensland Police where required and to the rental operator immediately.
-
9 mths
Standard CTP NOAC Deadline
Lodge a Notice of Accident Claim Form with the at-fault vehicle’s CTP insurer within 9 months of the crash or first symptom of injury, whichever is later.
-
3 mths
Nominal Defendant Claim (Unidentified Vehicle)
Where the at-fault vehicle is unidentified or fled the scene, the Notice must be served on the Nominal Defendant within 3 months. If the vehicle is identified but unregistered, the standard 9-month Notice of Accident Claim applies. Strict and rarely extended.
-
1 mth
Council / Public Liability PIPA Notice
For pothole, road defect or shared-path claims against a council or other public liability defendant, a Notice of Claim must be served within 1 month of consulting a lawyer (PIPA, Personal Injuries Proceedings Act).
-
3 yrs
Absolute Limitation Period
Court proceedings must be commenced within 3 years of the accident date. Most claims settle before this point, but the deadline is absolute.
Even where the deadline seems far away, evidence fades fast. Rental scheme ride records and device telemetry are overwritten, CCTV is recycled, witnesses move on, helmet-cam files get deleted, and road surfaces are repaired. Call us early. There's no obligation after the first conversation, and we'll lock in the time-critical steps.
Our Claim Process
Our 7-step process is designed for e-scooter, e-bike and PMD riders. We preserve the time-critical evidence (rental ride records, device telemetry, scheme operator data, helmet-cam files), identify the correct defendant, driver, operator, manufacturer or council, and lodge the right notice on time.
-
EXIT 1
1. Initial consultation
A no-obligation conversation about your crash, injuries, and circumstances. We’ll tell you straight whether you have a claim and which framework applies.
-
EXIT 2
2. Evidence preservation
We move fast on CCTV, helmet-cam files, GPS data, rental scheme telemetry, app screenshots, witness statements, the scene, and the device itself. Time-critical work that wins claims.
-
EXIT 3
3. Notice of Accident Claim
We lodge the correct notice on the correct party, CTP insurer, Nominal Defendant, council or other defendant, inside the strict statutory deadlines.
-
EXIT 4
4. Medical & rehabilitation pathway
We coordinate independent medical examinations, treatment plans and rehab while keeping costs covered as you go where possible.
-
EXIT 5
5. Quantum assessment
We build the value of your claim across general damages, past/future income, treatment, care and equipment, with specialist economists where needed.
-
EXIT 6
6. Settlement negotiation
Compulsory conference and direct negotiation with the insurer. Most claims settle here; if the offer isn’t right, the claim can go to court.
-
EXIT 7
7. Court proceedings if required
Where the insurer’s offer is inadequate, we issue and run proceedings in the right Queensland court. Many claims are resolved without going to trial.
Most e-scooter and PMD accident claims resolve within 12–24 months. Catastrophic injury matters take longer to ensure lifetime care needs are properly costed. We keep you informed at every step.
Evidence & Documentation You Should Collect
The strongest e-scooter and PMD claims are built on the evidence collected in the first hours and days. Rental ride records, app screenshots, helmet-cam footage, GPS data, photos of the device and witness contact details, every piece matters.

Frequently Asked Questions
Real answers to the questions e-scooter, e-bike and PMD riders actually ask after a crash. If yours isn't here, call us. There's no obligation after the first conversation.
The rental scheme operator (Beam and Neuron). They owe a duty of care to provide a safe device and have public liability cover. Photograph the device and serial number, save your ride record in the app, and report the fault before returning the device. We can issue a preservation notice on the operator to retain telemetry data.
No, but it can reduce damages on contributory-negligence grounds. An approved bicycle helmet is mandatory for e-scooter, e-bike and PMD riders in QLD. The reduction depends on whether helmet use would have changed the injury outcome, which is medically and legally argued.
It can. PMDs in QLD are limited to 25 km/h on bike lanes/paths and 12 km/h on footpaths. Devices that exceed the legal power or speed limit may be unregistered motor vehicles, which complicates CTP and may affect contributory negligence. We assess where you stand on the first call.
In QLD, pedal-assist (pedelec) e-bikes that cut out at 25 km/h with a motor ≤250 W continuous output are treated as bicycles for CTP and registration purposes. Throttle-only e-bikes are limited to 200 W. Higher-powered or modified e-bikes may be classified as unregistered motor vehicles, which can affect both your claim and any traffic offences.
Yes, against the council or contractor responsible for the road, bike lane or shared path. These are public liability claims under PIPA (Personal Injuries Proceedings Act 2002 (Qld)) with a strict 1-month notice deadline after consulting a lawyer.
Potentially yes. PMD riders owe a duty of care to other path users and must travel at the legal footpath speed (12 km/h in QLD). Your home-and-contents personal liability cover may respond. We also act for pedestrians injured by PMD riders, different sides of the same scenario.
