7NEWS Brisbane – New Queensland Cycling Law: What Compensation Rights Do Injured Cyclists Have? – June 2026
The coverage
Peter Carter, Principal Solicitor at Carter Capner Law, spoke with 7NEWS Brisbane about the new minimum passing distance enforcement laws for cyclists that came into effect in Queensland in June 2026. Carter explained that injured cyclists now have stronger grounds to pursue compensation under the Motor Accident Insurance Act when drivers fail to observe minimum passing distances.
“The new laws make it clearer that failure to observe the 1-metre rule is negligence per se,” Carter told 7NEWS. “This substantially strengthens the position of injured cyclists when making CTP claims against at-fault drivers.”
Carter advised cyclists injured in road accidents to seek legal advice immediately, noting that time limits apply and early evidence preservation is critical to a successful compensation claim.
