Incident Overview
Dalmain Enterprises Pty Ltd, trading as ATS Mining Maintenance, has pleaded guilty to a workplace safety charge following the death of heavy diesel mechanic Ty Drummond at a South Boulder workshop in Western Australia. The plea was entered in the Kalgoorlie Magistrates Court on 25 September 2026. Sentencing has not yet taken place.
Workplace, Location and Time
Mr Drummond, 25, died on 11 December 2023 at the company’s workshop in South Boulder, near Kalgoorlie. He had been instructed to remove the front axle from a Sandvik TH663 mining truck, a task that required the vehicle to be raised and supported.
Worker and Incident Details
WorkSafe WA alleged that a deflated front tyre left the truck leaning and that a supporting jack failed while Mr Drummond was underneath it. Those details describe the regulator’s account of the incident; the full circumstances and the basis for the amended plea remain matters for the sentencing court.
Fatality and Immediate Outcome
Mr Drummond was fatally injured. WorkSafe later commenced a prosecution against Dalmain Enterprises. The company pleaded guilty to an amended charge of failing to comply with a health and safety duty in circumstances causing death or serious harm to a worker.
Court Proceedings and Workplace Safety
ABC News reported that the prosecution also raised alleged shortcomings in risk assessment, instruction, supervision and the equipment used to support the truck. These matters should not be treated as separate findings by the court. Sentencing was adjourned to 10 February 2027, and no penalty has been imposed. The case underscores the need for a documented safe method and suitable support equipment before anyone works beneath heavy vehicles.
