Truck Injury Claim Evaluator

Get an indicative compensation range for a truck crash in Australia. We factor in Queensland, New South Wales and Victoria settings, including QLD ISV, NSW WPI thresholds and VIC serious injury.

Strict CTP deadlines apply. CTP Notice of Accident Claim Form within 9 months of the incident (or 1 month from first instructing a lawyer, whichever is earlier). Nominal Defendant (hit-and-run / unidentified vehicle): 1 month. If you were driving for work, a WorkCover statutory claim should also be lodged promptly. Court proceedings: generally 3 years, although the start date and any available extension depend on the circumstances. Call 1300 529 529 for a no-obligation first consultation.

⏰ Time Limits for Truck Injury Claims

Truck-related injury claims often run under more than one scheme at the same time. Each has its own short-notice deadlines that can affect or end your claim.

  • CTP – Notice of Accident Claim Form: within 9 months of the incident, or within 1 month of first instructing a lawyer (whichever is earlier).
  • Nominal Defendant (hit-and-run / unidentified vehicle): notify within 1 month to fully preserve rights; later notification up to 9 months may require reasonable excuse.
  • WorkCover (if you were driving for work): a statutory workers’ compensation claim should be lodged promptly with the relevant state authority.
  • Court proceedings: generally need to be started within 3 years, although the date the period begins and any available extension depend on the circumstances.
  • If your crash was over 18 months ago, contact us urgently for advice.

💡 How the Calculator Works

  • Identifies whether your claim is likely CTP (motor accident) or public liability (road hazard/defect)
  • Estimates components such as general damages (if thresholds met), past and future economic loss, medical, and care
  • Applies 3×AWE caps where relevant

Your selection helps us triage; the final liability position depends on evidence and the insurer's assessment.
This helps us determine whether a public road authority or a private occupier is responsible for the hazard.
Insurers sometimes raise 'contributory negligence' if restraints weren't used. This doesn't automatically bar a claim.
Question 3 of 8

Your Injuries

Pure psychological injuries can be more restricted in some jurisdictions and may have additional thresholds. If you suffered any physical injury, choose 'Yes'. If psychological only, choose 'No' and we'll flag it for review.

Frequently Asked Questions

How long do I have to make a road injury claim in Queensland?

Multiple deadlines run at once. CTP Notice of Accident Claim Form: 9 months after the accident, or 1 month after you first consult a lawyer, whichever is earlier. Hit-and-run via the Nominal Defendant: 3 months, and the claim is barred at 9 months. Court proceedings: 3 years. Miss the short ones and your claim can be barred entirely. Call before doing anything else.

What compensation can I claim for a road injury?

Past and future medical and rehab costs, economic loss (income and superannuation), pain and suffering (ISV-scaled under Queensland law), gratuitous and paid care, home and vehicle modifications, and out-of-pocket expenses. Catastrophic injuries can also access the National Injury Insurance Scheme Queensland (NIISQ) for lifetime treatment.

What if I was partially at fault for the accident?

You can still claim. Queensland applies contributory negligence. Your damages reduce by the percentage of your own fault (typical findings: not wearing a seatbelt 25%, intoxication 25–50%, riding without a helmet 15%). We work to minimise that finding through expert reconstruction and proper legal argument.

How long does a road injury claim typically take?

Most Queensland CTP claims settle 12–24 months after the accident. The clock is driven by your medical stabilisation. Under MAIA you can’t usually settle until injuries have stabilised so future losses can be calculated. Severe or disputed-liability matters can run 24–36 months. We file early and push hard at the compulsory conference to settle as soon as your medicals allow.
