⏰ Time Limits for Pedestrian Injury Claims

Queensland pedestrian and CTP claims have several deadlines running at once. Missing any of them can affect or end your claim.

  • CTP Notice of Accident Claim Form: within 9 months of the incident, or within 1 month of first instructing a lawyer (whichever is earlier).
  • Nominal Defendant (hit-and-run / unidentified vehicle): notify within 1 month to fully preserve rights; later notification up to 9 months may require reasonable excuse.
  • Court proceedings: generally need to be started within 3 years, although the date the period begins and any available extension depend on the circumstances.
  • If your incident was over 18 months ago, contact us urgently for advice.

  • Identifies whether your claim is likely CTP (motor accident) or public liability (hazard/premises)
  • Estimates components such as general damages (if thresholds met), past and future economic loss, medical, and care
  • Applies 3×AWE caps where relevant

Frequently Asked Questions

How long do I have to make a road injury claim in Queensland?

Multiple deadlines run at once. CTP Notice of Accident Claim Form: 9 months after the accident, or 1 month after you first consult a lawyer, whichever is earlier. Hit-and-run via the Nominal Defendant: 3 months, and the claim is barred at 9 months. Court proceedings: 3 years. Miss the short ones and your claim can be barred entirely. Call before doing anything else.

What compensation can I claim for a road injury?

Past and future medical and rehab costs, economic loss (income and superannuation), pain and suffering (ISV-scaled under Queensland law), gratuitous and paid care, home and vehicle modifications, and out-of-pocket expenses. Catastrophic injuries can also access the National Injury Insurance Scheme Queensland (NIISQ) for lifetime treatment.

What if I was partially at fault for the accident?

You can still claim. Queensland applies contributory negligence. Your damages reduce by the percentage of your own fault (typical findings: not wearing a seatbelt 25%, intoxication 25–50%, riding without a helmet 15%). We work to minimise that finding through expert reconstruction and proper legal argument.

How long does a road injury claim typically take?

Most Queensland CTP claims settle 12–24 months after the accident. The clock is driven by your medical stabilisation. Under MAIA you can’t usually settle until injuries have stabilised so future losses can be calculated. Severe or disputed-liability matters can run 24–36 months. We file early and push hard at the compulsory conference to settle as soon as your medicals allow.
