The Course of Sarah’s Claim Following a Vehicle Rear-End Incident
Sarah was in a stationary position in her vehicle when she was rear-ended by a car that failed to stop in time. This accident resulted in neck pain, cervicogenic headaches, and a shoulder injury for Sarah.
At the time of the accident, Sarah was working a demanding schedule of 48–50 hours per week at a hotel as Casual Bar & Wait Staff. Due to the physical limitations brought on by her injuries, she had to make adjustments to her work responsibilities. Initially moved to the front desk, Sarah later transitioned to a barista role. She has since changed careers and is now working as a hairdresser, a role that does not require her to lift her arms above her head.
The claim did not reach a settlement during the initial compulsory conference, and legal pleadings were filed. However, the matter was eventually settled at a subsequent R553 conference for $35,000, with no allowance made for costs. This settlement is intended to cover Sarah’s medical bills and compensate her for her changed employment circumstances.
