Overview

We are seeking individuals from each state to serve as class representatives in the Woolworths & Coles Class Action.

As the name suggests, the representative or representatives who lend their name to the litigation represent all members of the ‘class’ for whom the case is conducted, ie consumers who regularly shopped:-

  • at Woolworths between September 2021 and May 2023; and
  • at Coles between February 2022 and May 2023.

The claim will be conducted in the name of the person/s who become the class representative or representatives, i.e. John Smith; Jane Doe etc etc v Woolworths Ltd and Coles Ltd.

All of the court rulings will be under that title.

Obligations

The representative or representatives need to do the following:-

  • Sign a consent to be a class representative;
  • Sign an agreement on behalf of group members as to the legal costs associated with the action;
  • Be available from time to time by phone to discuss progress;
  • Be available from time to time in person e.g. to attend a court hearing.

Liability for legal costs

The representative or representatives will NOT be required to pay any legal costs of the class as they will be paid by a ‘funder’ or the matter will be conducted on a no-win no-fee basis.

One of the benefits of being a class representative is that we will apply to the court for a payment to be made to you for the time and effort put in by you in.

As a class representative, you will also have the knowledge you are playing a role in holding large corporations accountable and in amplifying the voices of affected consumers across Australia.

Who is eligible?

Regular Shopper: You regularly shopped:-

  • at Woolworths between September 2021 and May 2023; and
  • at Coles between February 2022 and May 2023.
  • Age Requirement: You are 18 years or older.
  • Household size: You represent one of the several typical household consumer grouping.
  • Average spend: Your spending pattern represents that of a typical household.

Proof of Regular Shopping

We understand that few consumers keep every receipt, but there are alternative ways to verify shopping habits during the relevant period:

  • Everyday Rewards or Flybuys Members: Consumers can obtain shopping history from their account.
  • Credit Card Statements: These can serve as proof of shopping patterns if a credit card was used.
  • Cash Purchases: For cash purchases, you may still qualify based on your recollection of items purchased, amounts spent, and shopping frequency.

Any adult who shopped regularly at Woolworths or Coles between September 2021 and May 2023 may qualify as a Class Representative. You should also have a clear recollection of your shopping habits during the relevant period or be able to provide proof of regular shopping through rewards programs or transaction history.

What types of documentation do I need to provide?

Documentation may include Everyday Rewards or Flybuys transaction history, credit card statements, or any other records that can demonstrate regular shopping activity at Woolworths or Coles during the specified period. If you paid primarily with cash, your recollection of items purchased and their pricing will also be considered.

What is the expected timeline for the class action?

We are currently preparing court documents and collecting data from consumers. We expect to start formal proceedings by early 2025. Regular updates will be provided to all registered participants to keep you informed of any significant milestones.
